These Terms & Conditions (“Terms”) govern your purchase of and participation in the 21 Day AI Home Design Challenge (“Challenge,” “Program,” or “Course”) offered by The Forest Dwelling LLC (“Company,” “we,” “us,” or “our”).

By purchasing or accessing the Challenge, you agree to these Terms.

1. The Program

The 21 Day AI Home Design Challenge is a digital educational program designed to demonstrate how artificial intelligence tools can be used to explore, visualize, organize, and evaluate ideas related to home design and decorating.

The Program may include prerecorded videos, prompts, examples, downloadable resources, community discussions, and other educational materials.

Program content may be released according to a schedule rather than being made available all at once.

2. Educational Purposes Only

The Program is provided for informational and educational purposes only.

Melissa “Misa” Liddiard is a home design enthusiast and is not acting as your interior designer, architect, engineer, contractor, financial advisor, attorney, or other licensed professional.

Nothing provided through the Program should be interpreted as professional design, architectural, engineering, construction, financial, legal, or other professional advice.

You are responsible for determining whether any idea, product, material, design choice, or recommendation is appropriate and safe for your home and circumstances.

When appropriate, consult a qualified professional before making construction, renovation, structural, electrical, plumbing, financial, or other significant decisions.

Purchase of or participation in the Program does not create a professional client relationship, fiduciary relationship, or other professional advisory relationship between you and the Company.

3. Artificial Intelligence Disclaimer

Artificial intelligence tools can produce inaccurate, incomplete, unrealistic, or inconsistent results.

AI-generated images may alter dimensions, scale, architecture, colors, materials, furniture, lighting, textures, products, or other details even when instructed not to do so.

AI-generated visuals are intended to help you explore ideas. They should not be treated as architectural plans, construction documents, exact product representations, or guarantees of how something will look in real life.

Always independently verify measurements, dimensions, product specifications, colors, samples, materials, pricing, availability, installation requirements, and feasibility before making purchasing or construction decisions.

Third-party AI platforms may also change their features, pricing, availability, terms, or results at any time. We do not control or guarantee the continued availability or performance of any third-party platform.

4. No Guaranteed Results

Your results will depend on numerous factors outside our control, including the tools you use, the information and images you provide, your decisions, your experience, your home, your budget, and implementation.

We do not guarantee any particular design outcome, AI result, cost savings, increase in property value, business result, affiliate revenue, income, or other outcome from participating in the Program.

Any examples shared in the Program are provided for educational and illustrative purposes and should not be interpreted as promises or guarantees of your results.

5. Income and Affiliate Marketing Information

The Program may discuss ways AI tools can potentially assist with content creation, affiliate marketing, or other income-generating activities.

This information is educational only.

We make no representation or guarantee that you will earn money as a result of participating in the Program. Starting or operating any business or income-producing activity involves risk, and individual results vary substantially.

Any examples of revenue, commissions, opportunities, or business strategies are not guarantees of future earnings.

Any earnings, revenue, commissions, testimonials, or results referenced in connection with the Program are provided for illustrative purposes only. They should not be considered typical, guaranteed, or a prediction of what you will achieve.

Your results may depend on factors including your experience, effort, existing audience, market conditions, business model, resources, and ability to implement what you learn.

6. Purchase, Payment, and Processing

6.1 Payment Processing

Payments are processed through third-party payment processors, which may include Stripe, PayPal, Affirm, Afterpay, Klarna, or other authorized payment providers available at checkout.

By completing your purchase, you authorize the applicable payment processor to charge your selected payment method for the amount displayed at checkout.

Your use of a third-party payment provider may also be subject to that provider's applicable terms and privacy policies.

We do not directly store your complete credit card or payment account information.

6.2 Pricing and Currency

Unless otherwise stated, all prices are listed in U.S. Dollars (USD).

The price and payment terms applicable to your purchase will be clearly displayed at checkout.

Prices, promotions, discounts, and availability may change at any time without notice. Any future price change will not affect a purchase you have already completed.

6.3 Payment Plans

If a payment plan is offered and you select that option, you authorize the applicable payment processor to automatically charge your payment method according to the payment schedule disclosed at checkout.

Unless otherwise required by law or expressly stated in writing, selecting a payment plan represents a commitment to pay the entire purchase price.

You remain responsible for all scheduled payments even if you stop participating in, accessing, or using the Program.

If a scheduled payment fails, we or our payment processor may attempt to process the payment again and may contact you regarding the outstanding balance.

We reserve the right to suspend access to the Program until overdue payments are brought current.

6.4 Buy Now, Pay Later Services

We may offer third-party financing or installment payment options through providers such as Affirm, Afterpay, or Klarna.

These services are provided and administered by independent third parties. Eligibility, approval, payment schedules, interest, fees, refunds, and other financing terms are determined by the applicable provider and are subject to that provider's terms and conditions.

We do not control approval decisions or financing terms offered by these providers.

6.5 Taxes

You are responsible for any applicable sales tax, VAT, GST, or other taxes associated with your purchase based on your location.

Applicable taxes will be calculated and collected where required by law.

6.6 Failed Payments

If a payment fails, we or our payment processor may attempt to process the payment again and may contact you using the information associated with your purchase.

If an outstanding payment remains unpaid, access to the Program may be suspended or restricted until the account is brought current.

6.7 Chargebacks and Payment Disputes

If you believe a charge was made in error or experience a problem with your purchase, please contact us at support@theforestdwelling.com so we have an opportunity to investigate and resolve the issue.

We reserve the right to suspend access to the Program while a chargeback or payment dispute is pending.

We may provide relevant records to the applicable payment processor, financial institution, or dispute-resolution provider in connection with a chargeback or payment dispute. These records may include transaction information, purchase terms, proof of agreement to these Terms, communications, and records showing access to or use of the Program.

Nothing in these Terms limits your right to dispute a genuinely unauthorized or erroneous charge or any other consumer rights available under applicable law.

7. Refund Policy

Because the 21 Day AI Home Design Challenge is a digital educational program that provides access to proprietary videos, prompts, resources, and course materials, all sales are final.

Please review the Program details carefully before purchasing.

Refunds, exchanges, or credits will not generally be provided for change of mind, failure to participate in or complete the Program, failure to use the Program, dissatisfaction with an AI-generated result, or failure to achieve a particular result.

If you experience a technical issue that prevents you from accessing the Program, please contact us at support@theforestdwelling.com and we will work with you to resolve the issue.

Individual results, including AI-generated results, will vary and are not grounds for a refund. We cannot guarantee specific design, financial, business, affiliate, or income results.

Nothing in this policy limits any refund or consumer rights that cannot legally be waived.

8. Personal-Use License and Intellectual Property

All Program materials, including but not limited to videos, lessons, written materials, prompts, prompt collections, frameworks, graphics, downloads, examples, worksheets, and other content created by us are owned by or licensed to the Company and are protected by applicable intellectual property laws.

Your purchase grants you a limited, personal, non-exclusive, non-transferable license to access and use the Program for your own personal use.

You may not reproduce, distribute, sell, sublicense, publish, share, upload, teach, copy, commercially exploit, or provide access to Program materials to another person without our prior written permission.

Your purchase is for one participant unless otherwise expressly stated.

You may use skills and concepts you learn through the Program in your own projects and business activities, but you may not copy, resell, distribute, or represent our proprietary Program materials or resources as your own.

9. Community Participation

If your purchase includes access to a private community, you agree to communicate respectfully and refrain from harassment, discrimination, spam, unauthorized promotion, illegal activity, or conduct that materially interferes with other participants' experience.

We reserve the right to remove content or revoke community access for material or repeated violations of these rules.

Revocation for a violation of these Terms does not automatically entitle you to a refund.

Please use discretion when sharing personal information, photographs, home information, or other content within the community.

10. Third-Party Platforms and Services

The Program may reference or use third-party platforms, products, websites, software, or AI services, including services that require separate accounts or subscriptions.

Unless expressly stated otherwise, those third parties are independent from us. Their products and services are governed by their own terms and privacy policies.

We are not responsible for changes, interruptions, errors, pricing, data practices, or availability of third-party services.

Any separate fees or subscriptions charged by third-party services are your responsibility unless expressly stated as included with your purchase.

11. Technology Requirements and Access

You are responsible for maintaining the technology reasonably necessary to access and participate in the Program, including a reliable internet connection, compatible device, current web browser, valid email address, and any third-party applications or accounts required for activities you choose to participate in.

You are responsible for keeping your login credentials secure.

While we will make reasonable efforts to provide access to the Program, we do not guarantee compatibility with every device, browser, operating system, or third-party application.

We also do not guarantee uninterrupted access. Program or community access may occasionally be interrupted because of maintenance, updates, third-party outages, technical problems, or circumstances beyond our reasonable control.

Temporary interruptions in service do not automatically entitle you to a refund.

This adds the useful technology/access protection from the example you sent without including overly specific requirements like a particular internet speed or browser version. The source document's version covers these issues in considerably more detail.  

12. Affiliate Links

From time to time, we may recommend or link to products or services for which we receive an affiliate commission.

When applicable, affiliate relationships will be disclosed as required by law.

You are never required to purchase a recommended product through an affiliate link to participate in the Program.

13. Assumption of Responsibility and Risk

You remain solely responsible for decisions you make based on information presented in the Program.

You understand that home improvement, renovation, purchasing, business, and financial decisions can involve risks and costs, and you agree to exercise your own judgment and seek qualified professional advice when appropriate.

You assume responsibility for decisions you make regarding products, materials, purchases, renovations, AI-generated information, business activities, affiliate activities, or other actions you take based on information presented in the Program.

You acknowledge that implementation of ideas or strategies taught in the Program may not produce your desired result and may involve financial expenditures, time, or other risks.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR PARTICIPATION IN OR RELIANCE UPON THE PROGRAM.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO YOUR PURCHASE OR USE OF THE PROGRAM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PROGRAM.

Nothing in these Terms excludes liability that cannot legally be excluded or limited.

15. Changes to the Program

We may make reasonable updates to Program materials, technology, platforms, schedules, or delivery methods as the Program evolves.

We may also update these Terms prospectively when necessary to reflect changes in our business, services, or applicable law.

16. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.

17. Severability

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect to the extent permitted by law.

18. Entire Agreement

These Terms, together with the Refund Policy, Privacy Policy, and any terms displayed at checkout, constitute the agreement between you and the Company regarding your purchase and participation in the Program.
